These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Soil Health Foundation ("SHF," "we," "us," or "our") in accordance with the Indian Contract Act, 1872 and the Information Technology Act, 2000.

If you do not agree with any part of these Terms, you must discontinue use of the website immediately. Your continued access to or use of the website following the posting of any changes to these Terms constitutes acceptance of those changes.

2. About the Foundation

Soil Health Foundation is an Indian non-governmental organisation dedicated to promoting sustainable soil management, regenerative agriculture, and environmental conservation across India. Our work encompasses research, education, community outreach, and advocacy aimed at restoring and preserving soil health for current and future generations. SHF operates in accordance with applicable Indian laws governing charitable and non-profit organisations.

3. Use of Website

This website is provided for informational and educational purposes only. The content published on this website — including articles, research summaries, programme descriptions, agricultural guidance, and other materials — is intended to raise awareness about soil health and related environmental topics.

While we endeavour to ensure that the information on this website is accurate, current, and complete, we make no representations, warranties, or guarantees — express or implied — regarding the completeness, accuracy, reliability, suitability, or availability of any information, content, or materials provided. Any reliance you place on such information is strictly at your own risk.

The educational content on this website does not constitute professional agricultural, scientific, legal, financial, or medical advice. Users should consult qualified professionals before making decisions based on information found on this website.

4. User Accounts

The website does not currently require or offer user account registration. However, SHF reserves the right to introduce user account functionality in the future for purposes such as volunteer coordination, event registration, newsletter subscriptions, or community engagement.

Should user accounts be introduced, additional terms and conditions will apply. Users will be responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their accounts. SHF reserves the right to suspend or terminate any user account at its sole discretion if these Terms are violated.

5. Donations

All donations made to Soil Health Foundation are entirely voluntary and made at the donor's own discretion. We deeply appreciate every contribution towards our mission.

Non-Refundable: Donations are generally non-refundable once received. In exceptional circumstances, refund requests may be considered at the sole discretion of SHF's management. Any such request must be made in writing to admin@soilhealthfoundation.com within 30 days of the donation.

Tax Benefits: As Soil Health Foundation is a newly established organisation, we are not yet registered under Section 80G of the Income Tax Act, 1961. Accordingly, donations made to SHF are currently not eligible for tax deductions under Section 80G. We intend to pursue such registration in due course, and donors will be notified when tax-exempt status is obtained. Donors are advised to consult their own tax advisors regarding the tax implications of their contributions.

Payment Methods: At present, the website does not feature an integrated payment gateway. Donations are accepted via UPI (Unified Payments Interface) and direct bank transfer. Payment details will be provided upon request or as displayed on relevant pages of the website. SHF is not responsible for any errors, delays, or failures in third-party payment processing systems.

Use of Donations: All donations are utilised in furtherance of SHF's charitable objectives. SHF reserves the right to allocate donated funds to any of its programmes, initiatives, or operational expenses as it deems appropriate, unless a donor specifies a particular programme and SHF agrees in writing to honour that restriction.

6. Intellectual Property

All content on this website — including but not limited to text, articles, research papers, graphics, logos, icons, images, photographs, videos, audio clips, software, and the design, selection, and arrangement thereof — is the exclusive property of Soil Health Foundation or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India and international treaties.

No Reproduction Without Permission: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any content from this website without the prior written consent of SHF, except as expressly permitted below.

Personal Non-Commercial Use Exception: You may view, download, and print pages or content from this website for your personal, non-commercial, educational use only, provided that you do not modify the content and that you retain all copyright, trademark, and other proprietary notices. This limited permission does not extend to any commercial or public use of the content.

The Soil Health Foundation name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SHF. You may not use such marks without the prior written permission of SHF.

7. User-Submitted Content

When you submit any content to SHF through the website — including but not limited to messages via the contact form, volunteer applications, feedback, suggestions, stories, photographs, or any other materials ("User Content") — you grant SHF a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such User Content in any media format and through any channels, in connection with SHF's charitable activities and operations.

You represent and warrant that you own or have the necessary rights and permissions to submit such User Content, and that it does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. You further represent that your User Content does not contain any unlawful, defamatory, obscene, or otherwise objectionable material.

SHF is under no obligation to use, acknowledge, or compensate you for any User Content submitted. SHF reserves the right to remove or decline to publish any User Content at its sole discretion.

8. Prohibited Conduct

When using this website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation, including but not limited to the Information Technology Act, 2000 and the Indian Penal Code, 1860.
  • Attempt to gain unauthorised access to any part of the website, its servers, databases, or any connected networks or systems (hacking), as prohibited under Sections 43 and 66 of the Information Technology Act, 2000.
  • Interfere with or disrupt the integrity, security, or performance of the website, its servers, or connected infrastructure.

10. Disclaimer of Warranties

This website and all content, materials, information, services, and products available through it are provided on an "as is" and "as available" basis without any representations or warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, including the Consumer Protection Act, 2019, SHF expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the website will be available, uninterrupted, timely, secure, or error-free.
  • Warranties that the information or content on the website will be accurate, complete, reliable, or current.

11. Limitation of Liability

In no event shall the aggregate liability of SHF for all claims relating to the website exceed the sum of Indian Rupees One Thousand (INR 1,000) or the amount you have donated to SHF in the twelve (12) months preceding the claim, whichever is lower. Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of these Terms, shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the original intent of the severed provision.

17. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Soil Health Foundation regarding your use of this website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the website. No waiver of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition.

Soil Health Foundation reserves the right to revise, amend, or update these Terms at any time and at its sole discretion. Any changes will be effective immediately upon posting the revised Terms on this page, with the "Last updated" date amended accordingly.

Your continued use of the website following the posting of revised Terms constitutes your acceptance of and agreement to be bound by the updated Terms.
